Atiku had appealed against the presidential tribunal’s dismissal of his petition against the declaration of President Muhammadu Buhari as winner of the February 23 presidential election.

The apex court had earlier, during the hearing rejected Atiku and PDP’s request that their seven interlocutory appeals should be heard after the main appeal (SC.1211/2019) must have been heard.

But the Chief Justice of Nigeria (CJN), Tanko Mohammed, who led the seven-man panel on Atiku’s appeal, overruled the petitioners on the grounds that it was unnecessary to hear the 7 interlocutory appeals when the main appeal to be adopted would cover all the other interlocutory appeals.

The seven-man panel that heard the appeal are the Chief Justice of Nigeria (CJN) Tanko Mohammed, and justices Rhodes-Vivour, Amiru Sanusi, Uwani Abaji, Ejembi Eko, John Inyang Okoro, Olukayode Ariwoola.
