Justice Obiorah Egwuata in his ruling, also awarded N200, 000 costs against the commission.

Justice Egwuatu said the commission was wrong by not availing the Emir opportunity to defend himself before submitting the report to the government which is an infringement on his fundamental rights to a fair hearing.

The judge, while granting the prayers of the plaintiff, dismissed the report, saying fair hearing was a fundamental right and in conformity with the principles of natural justice.

Emir Sanusi II had on June 7, 2019 filed a suit asking the court to declare the submission of the commission for the investigation of the emirate finances without according him opportunity to defend himself was a breach of his fundamental human rights as contained in section 36 of the Constitution and therefore an order of the court quashing the report.
