UPDATED: Court Nullifies Impeachment of Kogi Ex-Deputy Governor

A Kogi State High Court has declared the impeachment of former Kogi state deputy governor, Simon Achuba, null and void.

Justice John Olorunfemi presided over the judgment on Thursday.

He also said that the nomination of the incumbent deputy governor, Edward Onoja, did not follow due process and was a violation of the constitution.

Hours after the judgment, Onoja tweeted that God will not bring down a person that trusts in him.

Channels TV reports that the judge described the action of the Kogi State House of Assembly as a constitutional coup, hatched and executed in a democracy explaining further that the action is contrary to Section 188 subsection 8, a section that stopped the Assembly from further action having discovered that the former deputy governor was not found wanting by the panel.

Simon Achuba was impeached by the State House of Assembly in October 2019, following recommendations of the Judicial Panel of Inquiry that investigated allegations of gross misconduct levelled against him.

But Achuba through his counsel, Jibrin Okutachi (SAN) had filed an application to the court, urging it to nullify his removal and return him as the state’s deputy governor.
