The Federal Government has appealed against Wednesday’s ruling upholding the no case submission in the corruption case against Justice Adeniyi Ademola, his wife, Mrs. Olabowale Ademola and one other, a Presidential source has said.

According to the source, upholding the no case submission in the corruption case against Justice Adeniyi Ademola, Mrs. Olabowale Ademola and Mr Joe Agi, was necessary to save the war against corruption.

“In efforts to save the war against corruption following a streak of losses in the courts, the Federal Government yesterday (Thursday) filed an appeal against the decision of Justice Jude Okeke to uphold the no case submission in the corruption case against Justice Adeniyi Ademola, Mrs. Olabowale Ademola and Mr. Joe Agi, SAN,” the source was quoted as saying by the Premium Times.

“The Government through the Ministry of Justice has also filed a fresh case in the Code of Conduct Tribunal against Justice Ademola and wife for living above their means and failure to declare their assets.

“Of interest is the decision of the learned trial judge that the offence of giving and receiving gratification was not made out by the Prosecution against the Defendants in the face of the evidence held in court.”

The trial judge, Justice Jude Okeke in his ruling on Wednesday, held that the prosecution did not adduce enough evidence to warrant the defendants to enter defence.

He said that the prosecution did not establish a prima facie case against the defendants, adding that no iota of evidence to proof that Justice Ademola and co. were guilty of the charges levelled against them.

Ademola was among the seven justices investigated after the sting operations carried out in October, 2016 by the Department of State Security.

The office of the Attorney General of the Federation (AGF) had filed the suit late last year, in which they were accused of engaging in corrupt acts.

His wife was accused of receiving N30million in her Guaranty Trust Bank account on behalf of her husband, while Agi was accused of bribing the judge, including buying an N8.5million car for his (the judge’s) son.

They were arraigned by the Federal Government on charges bordering on criminal conspiracy to receive gratification in various ways, contrary to Section 8(1) (a) of the Independent Corrupt Practices and other Related Offences Act 2000.
