N50m Fine: Adamawa Senator Appeals Judgment Over ‘Assault’ At Sex Toy Shop

The Senator representing Adamawa North Senatorial District, Elisha Abbo, has filed an application at the Appeal Court, appealing the earlier judgment of a High Court in Abuja in an assault case involving one Osimibibra Warmate.

The lawmaker prayed the court to halt the execution of the High court judgment until he proved his argument.

THE WHISTLER earlier reported that a High Court sitting in the Federal Capital Territory(FCT), had on September 28, slammed a N50 million fine on Senator Elisha Abbo for alleged assault.

Warmate’s counsel, Lugard Tare-Otu, had maintained that the judgment was well deserved.

“I was a leading member of the team, with @nellymacaroni which filed the Court papers in a civil suit between Ms. Warmate v. Senator Elisha Abbo, for the assault of Ms. Warmate at an adult shop in Abuja. Excited to announce, Court slammed damages of N50m against Senator Abbo today,” Lugard Tare-Otu stated.

It will be recalled that a Magistrates’ Court sitting in Zuba, Abuja, had dismissed the assault case filed against Elisha Abbo.

CCTV footage had shown Abbo allegedly assaulting a nursing mother, Warmate, at a sex toy shop in Abuja.

But, the senator later apologised for his conduct at a press conference.

His notice of appeal reads in part:

“That the appellant being dissatisfied with the decision of the High Court of the FCT as contained in its ruling and orders in Suit No CV/2393/2019 delivered on the 28th day of September, 2020 by Hon. Justice S.U Bature, do hereby appeal to the Court of Appeal, Abuja.”

He also called for “an order of this honourable court staying the execution of the judgment/decision of this honourable court delivered on September 28, 2020 in Suit CV/2393/2019 pending the hearing and determination of the appeal against same.”
