Court Condemns KPMG For Scrutinising Employee’s Phone

The Employment and Labour Relations Court has described as unlawful, KPMG’s scrutiny of private phone of one of its employee’s being investigated for fraud.

Lady Justice Monica Mbaru of the said court in Kenya, faulted the audit firm for invading Ms Gloria Jepkurui Koima’s personal information in a bid to uncover the fraud allegedly perpetrated by the employee.

KPMG had allegedly seized Koima’s phone and used the information obtained from the gadget as evidence against her in a disciplinary proceeding.

But Justice Mbaru in her ruling, directed KPMG to expunge all the data obtained from Koima’s phone, adding that the firm will only be allowed to use informed sourced from the employee’s work telephone and laptop as evidence before the disciplinary hearing.

“All information obtained from Ms Jepkurui’s personal phone shall be returned in soft or hard copies and shall not form part of her work records unless she wishes to use the same in her case voluntarily,” Justice Mbaru ruled.

Ms Koima had instituted the suit against the firm after she was asked to resign from her position in KPMG Advisory Services where she had worked for about seven years.

She alleged persecution against her by KPMG after she was investigated for having an affair with one of her superiors in the firm.
