JUST IN: Appeal Court Dismisses Suit Challenging Yahaya Bello’s Nomination In 2015

The Appeal Court in Abuja on Thursday dismissed the application of one Michael Elokun; filed against a Federal High Court judgement which had affirmed that Kogi State governor, Yahaya Bello, was duly nominated by his party(All Progressives Congress) ahead of the 2015 gubernatorial election in the state.

Justice Stephen Adah read the unanimous judgement of the panel.

Recall that the trial court in Abuja had on March 20, 2018 , quashed Elokun’s case, saying that he and others in the matter lacked “locus standi” in determining the nomination of Bello.

Justice J. Tsoho of the court also struck out the suit on the grounds that it was an abuse of court process.

But Elokun, through his counsel, J.M Agbadu, later approached the higher court, seeking among other things – a declaration that Idris Wada( of the People’s Democratic Party) is entitled to return as governor of Kogi.

But Justice Adah said that he agreed totally with the lower court’s judgement.

“The crux of this appeal has to do with the jurisdiction of the lower court.

“We’ve looked at the decision of the lower court and discovered that it is true.

“We find that there is no merit in this appeal and it is hereby dismissed,” he said.
