Appeal Court Reduces Ex-Governor Dariye’s Jail Term To 10yrs

Former Governor of Plateau State, Joshua Dariye will now spend 10 years in prison on charges of criminal breach of trust and criminal appropriation of the state’s funds running to over N2billion.

This was the ruling of the Abuja Division of the Court of Appeal on Friday.

The former governor had approached the Appeal court after a federal high court in Abuja sentenced him to 14 years imprisonment.

The ex-governor was convicted on 15 out the 23 counts preferred against him in July 2007 while one Reverend Jolly Nyame of Taraba State was convicted on a total of 27 out of the 41 counts preferred against him.

The appeal court ruled that the lower court erred in law when it sentenced Dariye, a first-time offender, to the maximum 14 years term contained in the charge against him.

According to the court, the sentence was handed down in the season of the Administration of Criminal Justice Act which does not allow maximum sentence for first-time offenders.
