Court Reinstates Sacked FOUYE Lecturer

Nigeria’s National Industrial Court sitting in Abuja has ordered the management of the Federal University, Oye Ekiti, to reinstate one of its sacked lecturers, Adeyemi Oluwagbemiga.

Adeyemi Oluwagbemiga, who lectured at Demography and Social Statistics department in FUOYE, was sacked in 2018 by the management for an alleged misappropriation of Tertiary Education Fund (TETFund).

But in a ruling on Friday, Justice of the court, O. O. Oyewumi, declared the sack of the lecturer in the Department of Demography and Social Statistics as illegal, null, void and of no effect.’

The court said the sack of the claimant in a letter dated 31st October 2018 from FUOYE “is hereby set aside and this shows that the claimant is still in the employ of the university.”

Justice Oyewumi held that “the claimant is entitled to be reinstated to his erstwhile position without any loss of seniority, rank and entitlements whatsoever.

“That the defendant is restrained from further interfering with the claimant’s rights, privileges and performance of his duties as an associate professor in the defendant (FUOYE).”

The suit, number NICN/AK/64/2018 filed by Funmi Falana, T. Gbadamosi and Tolulope Aguda, on behalf of the plaintiff, had named FUOYE as a defendant.

In the suit, the lawyers to the plaintiff, had asked the court to nullify the dismissal, praying the court to also ensure that all the benefits attached to his position as an Associate professor during the period of his dismissal be given him.
