US Election: Appeal Court May Dismiss Trump’s Case For ‘Defective’ Submission

The United States Court of Appeal sitting in Michigan, has faulted the suit filed by President Donald Trump, regarding the elections in the state, warning that the case may be dismissed unless some additional documents are filed.

Judge Cynthia Diane Stephens gave the ruling.

She directed Trump’s client to refile its case in line with the law.

Former Vice President, Joe Biden, was projected to have secured 2,790,648 popular votes ahead of President Donald Trump (2,644,525).

But Trump had claimed that there were widespread fraud in the state’s election and in other states.

However, Biden has maintained that his legal team would defend the rights of Nigerians who have voted for him.

The court ruling (dated November 9) reads:

“This office has received your papers in the above captioned matter. I regret to inform you that your submission is defective because it was not accompanied by the following:

  • a copy of the judgment or order appealed from under MCR 7.204C) or MCR 7.205(B)(2)
  • a copy of the register of actions (lower court docket entries), MCR 7.204CI5) & 205(B)(2)
  • a copy of the transcript or evidence that the transcript has been ordered – MCR 7.205(B)4)
  • five copies of a brief conforming to MCR 7.212(C)

“Unless the above is filed within 21 days of the date of this letter, your case may be dismissed for failure to pursue the case in conformity with the rules.

“This is the only notice that will be sent to you. If you have any questions concerning this matter, please call this office.”
