The Department of State Services (DSS) has withdrawn its suit that sought a court order to revoke the bail granted to four supporters of Yoruba nation agitator, Sunday Igboho.

Recall that the Federal High Court had on August 4, 2021 granted bail to the 12 detained aides and supporters of Igboho.

The detainees’ main lawyer, O. Pelumi, had sought for their bail on the grounds that the DSS was violating their fundamental human right, having arrested and detained them for over 30 days.

DSS counsel, I. Awo, had agreed that 8 of the applicants should be granted bail.

But for 4 of the detainees (2,5,12,6 applicants) he had claimed that investigation showed that they were complicit in arms stock piling.

However, Justice Egwatu had ruled that the 12 applicants be granted bail, saying, “No doubt, the administration of bail is at the discretion of the court.”

The judge said the bail conditions for the 8 detainees would include a surety and N5 million.

The 4 other detainees were asked to provide N10 million and 2 sureties who must be a civil servant residing in Abuja.

But weeks after the DSS filed a motion asking the court to revoke the bail of the four detainees, the DSS counsel informed the judge on Tuesday that the state service wants to withdraw the suit.

Awo further said that the DSS will now challenge the bail granted to the applicants at the Appeal Court.

Responding, Adebayo said he would not oppose the DSS assertions, but he told the judge that he was having issues serving the release order on the DSS.

In his ruling, Justice Egwatu struck out the DSS’ motion to revoke the detainees’ bail.
