BREAKING: Court Nullifies NASS’ Electoral Sequence Amendment

A Federal High Court sitting in Abuja on Wednesday nullified the alteration of the 2019 election sequence by the National Assembly

The Court nullified Clause 25, Section 15 of the Electoral Amendment Bill passed into law by the National Assembly.

The Trial Judge, Justice Ahmed Mohammed, also declared that the 1999 Constitution empowers Independent National Electoral Commission, INEC, to organize and supervise elections including fixing dates and sequences.

The court also ruled that the National Assembly lacks the powers to over-ride the actions of INEC.

Recall that the Senate had on February 14, approved an amendment to the electoral process which places the Presidential election as the last of the polls to be conducted in the country, while that of the National Assembly will hold first, followed by gubernatorial and state houses of assembly polls.
